Historic Ryan school murder 16-year-old accused to be tried as an adult

On Wednesday, the Juvenile Justice Board (JJB) in Gurugram said the 16-year-old student of Ryan International School, accused of murdering a junior seven-year-old Pradhyuman Thakur will be tried as an adult.

Victims father filed the application and after hearing JJB ordered that accused will be tried as adult.

Moving the application on November 15, seeking the trial of the juvenile as an adult, the victim’s father argued that the manner in which the throat of the seven-year-old was slit showed that the crime was “chilling”, “horrific” and “serious” in nature.

juvenile accused would be tried as an adult and produced before the sessions court on December 22, 2017.

“The verdict of the board that the juvenile will be treated and tried as an adult is historic. The juvenile will now be produced before a sessions court and the judge will then assign the case to the relevant Child Sessions Court for the trial,”

Juvenile accused if convicted, would not be set free after three years and could be sentenced to even 14 years in jail.

“In case of conviction, the juvenile will stay in the Observation Home till the age of 21. But as per Section 21 of the JJ Act, he cannot be sentenced to death or life imprisonment.”

Pradhyuman, the Class II student, was found with his throat slit in the school bathroom on September 8.

After that police arrest the School bus conductor Ashok Kumar

Later case was handed over to CBI.
The agency had also probed the involvement of the bus conductor arrested by Gurgaon police in connection with the murder, but could not find evidence indicating his involvement.
The teenager was reportedly under CBI scanner after the agency enhanced a grainy CCTV footage obtained from the school, which showed the victim going into a washroom
After investigating the case CBI during a press conference on November 8, had claimed that the Class XI student had confessed to slitting the child’s throat in the school’s bathroom in the hope of postponing the examinations and a parent-teacher meeting.

This is the first time in India a 16 year-old boy will be tried as an adult accused.
