The central government through the income tax department had filed a criminal complaint in 1996 under Section 35-B of the Wealth Tax Act, alleging that Jayalalithaa had failed to file returns in due time for the assessment year 1993-1994.

The department launched criminal proceedings in 1996 and 1997 against Jayalalithaa for not filing income tax returns for the assessment year 1993-94, though she had taxable income.

Cases were also filed against her associate Sasikalaa and Sasi Enterprises for 1991-92 and 1992-93.

The trial court dismissed the discharge applications filed by Jayalalithaa and Sasikalaa and the Madras High Court dismissed their appeals against the trial court order.

On Thursday, January 30, 2014, Supreme Court of India ordered a trial court to prosecute
Tamil Nadu Chief Minister J Jayalalithaa for not filing the Income Tax returns.

Jayalalithaa is facing a trial in an income tax related case for not filing IT returns between 1991 and 1994.

She says that she had no income in those three years, she did not file IT returns. The IT department filed a case against her in a court.

Jayalalithaa had questioned it before the Supreme Court. The SC has instructed the lower court to go ahead with the prosecution of Jayalalithaa.

It has also set a deadline of four months to complete the trial.

Jayalalithaa has to prove before the trial court that the reasons given by her for not filing the IT returns were genuine.

India needs a law whatever may be the crime related to income tax or any type of tax
If Trial Court does not come to conclusion in 1 year the procedure should automatically declare him not guilty and the new case should be filed on government officers for delaying case with provision of life imprisonment for delaying case and cheating government of India and citizens of India
