One of Big loophole in Indian law system –
The Chautalas can continue as MLAs in the current Assembly till the expiry of its term in October 2014 despite their conviction today.
Elected Politicians get protection under Section 8(4) of the Representation of People (RP) Act, 1951, which allows convicted MPs and MLAs to retain their status as representatives of their constituencies in the Lok Sabha or the respective Assemblies.
After getting punishment what convicted criminal politician has to do?
The criminal convicted MP or MLA have to simply file an appeal against the conviction within three months.
2nd loophole in the Indian Election laws
Convicted MP or MLA is allowed to contest the election again if the high court or the Supreme Court stays their conviction-pending disposal of their appeal.
Recruitment Scam happened in Year 2000
Today it’s January 2013.
Number of Accused – 62
Six died during the trial period
One was discharged by the Court at the time of framing of charges.
former Haryana chief minister Om Prakash Chautala age 78 and still case is going on.
Crime happened in year 1989.
Special CBI Judge Vinod Kumar held Chautala, his son and others guilty of offences under relevant sections of the Prevention of Corruption Act (PCA).
The court has fixed January 17, 19 and 21 for hearing the arguments on the sentence.
Chautala was held as the “main conspirator” by Special CBI Judge Vinod Kumar in his 308-page verdict.
On Wednesday Indian National Lok Dal (INLD) party supremo and former Haryana chief minister Om Prakash Chautala, his MLA son Ajay Chautala and 53 others were convicted by a Delhi court in connection with illegal recruitment of over 3000 junior basic trained (JBT) teachers in Haryana, by replacing the original selection list compiled from 18 districts with fake ones.
Ajay Chautala, is currently an MLA and is facing trial in a case of disproportionate assets.
All the criminals were immediately taken into judicial custody and sent to Tihar Jail barrack number 4
Sanjiv Kumar, the then Director of Primary Education, Chautala’s former Officer on Special Duty Vidya Dhar and Sher Singh Badshami, the political adviser to the then Haryana CM were also convicted.
Sanjiv Kumar, who claimed to be the whistle-blower in the case, was also held guilty.
Year 2000 - Chautala Government appointed 3032 JBT Teachers.
The CBI had registered a case against 62 officials and politicians on May 24, 2004.

The CBI had filed the chargesheet in the case charging the accused under
Sections 120B (criminal conspiracy),
420 (cheating),
467 (forgery),
468 (forgery for cheating),
471 (use of forged document showing it as genuine) of the Indian Penal Code (IPC) and under the provisions of the Prevention of Corruption Act (PCA), 1988.
The trial court had taken cognizance of the chargesheet on July 16, 2008 and framed charges on July 23, 2011 against 61 persons
In arguments CBI advocate told to court that each teacher paid a bribe of Rs 3-4 lakh and that Chautala, who held the education portfolio at the time of the scam, gave written instructions to Kumar demanding the original list of candidates be replaced.
Year 2003 –
IAS officer Sanjiv Kumar filed a writ petition in the Supreme Court alleging that the Chautala government had resorted to corrupt practices while recruiting the junior teachers in 2000.
The Supreme court handed the case to CBI to investigate the case.

Former Haryana Chief Minister Om Prakash Chautala and his son Ajay, Sher Singh Badshami along with IAS officers Vidhyadhar (then officer on special duty to the chief minister) and Sanjeev Kumar (then Director Primary Education) have been jailed for 10 years in connection with the illegal recruitment of Junior Basic Trained (JBT) teachers by Special CBI Judge Vinod Kumar
Excellent Judgment
In this case, no teacher has lost his job because of this corruption.
Why they did not lose the job?
I do not know how many teachers paid how much money and got the Job.
The recruitment was done for over 3,200 teachers in 1999-2000, when Chautala was chief minister.
Now they are convicted for tampering or changing the list and doing this the teachers who paid money to them got the job.
Don’t you think elected Politicians when do corruption it amounts to treson
For Treson punishment is death so corrupt politicians need to be given a death punishment.
