Police case registered against rationalist Sanal Edamaruku for hurting religious sentiments

FIR, Police case is registered against rationalist Sanal Edamaruku in Mumbai He has been accused of hurting religious sentiments

Sanal told to CNN IBN that he had to leave India or else he would have been arrested without bail.

In March 2012, when water started dripping from a cross at a Mumbai church, locals called it a miracle.

Edamaruku checked the area and established that the miracle was just a plumbing defect and the source of the dripping water could be a sewage line running close to the cross.

The rationalist was accused of blasphemy FIR is filed under section 295(A) of the IPC, it is a non-bailable offence.

Edamaruku said that he would never apologize for something that he has scientific evidence for.

Currently Sanal Edamaruku is in Finland, last six months he is staying in Finland as case was registered against him when he was in Finland.

Section 295A -
Deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs

[295A. Deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs.—

Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of 2[citizens of India], 3[by words, either spoken or written, or by signs or by visible representations or otherwise], insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to 4[three years], or with fine, or with both.]


CLASSIFICATION OF OFFENCE


Punishment—Imprisonment for 3 years, or fine, or both—Cognizable—Non-bailable—Triable by Magistrate of the first class—Non-com­poundable.

Suggested Reform - India needs scrap and delete the section 295A or amendment should be added that complaint should prove that why the accused is wrong with the help of science.

Offence should be made bailable with no right to police to arrest the accused without orders from the Court.

Section 295A is another tool to harass the honest people who say what is in their heart.

@MEcoyRespecting religion is another thing, the poor victims of this scam were drinking sewage water, believing that it would even cure their illnesses, exposing that is not an act of disrespect, it is a very humane thing to do.
