Explosive Judge Loya’s Two Friends who knew truth  died mysteriously

Currently Supreme Court is hearing two petitions demanding an independent probe into Judge Loya’s death.

As per Caravan Report Judge Loya was in Nagpur for the 30 November, 2014 wedding of the daughter of another sitting Judge at the Mumbai Sessions Court, Swapna Joshi. On 1 December, his family members received calls informing them about his demise after suffering a cardiac arrest. There were large variations in the precise time of his death and that fact that Judge Loya’s phone was wiped clean of all data before it was returned to the family. The Judge’s postmortem report was also allegedly signed by paternal cousin, when his family says there is no such person in the family. Further, his family members had noticed blood on his clothes.

Another article said alleged that Justice Mohit Shah had offered Judge Loya Rs. 100 crores for a judgment in favor of Mr. Amit Shah. The article had quote the Judge’s sister, who claimed that Justice Shah would “would call him late at night to meet in civil dress and pressure him to issue the judgment as soon as possible and to ensure that it is a positive judgment.

My brother was offered a bribe of 100 crores in return for a favorable judgment. Mohit Shah, the chief justice, made the offer himself. “

Shortly after Judge Loya’s death, a new Judge, M.B. Gosavi had discharged Mr. Amit Shah, after hearing the case for three days. The article goes on to question the manner in which the trial took place, asserting that it had violated a September 2012 Supreme Court order, that the Sohrabuddin trial “should be conducted from beginning to end by the same officer”.

Judge Loya was persuaded to attend a wedding at Nagpur on November 30 but the next morning he was dead, allegedly of cardiac arrest.

Soon after, Judge Loya allegedly died of a cardiac arrest on 1 December, 2014 in Nagpur, where he had gone to attend a wedding. Subsequently, both Mr. Khandalkar and Mr. Thombre died mysterious deaths who knew about Judge Loya and his problems regarding murder trial and pressure from many sides.

Senior Congress leaders Kapil Sibal, Salman Khurshid in a press conference held at Congress headquarter on Wednesday said following, it was not just BH Loya, judge of the special CBI court hearing the discharge petition of BJP president Amit Shah, but also a retired district judge and a lawyer, both from Nagpur and who Loya had confided in, who also allegedly died under suspicious circumstances.

An alleged attempt on the life of the only surviving witness, lawyer Satish Uike, was also made, and this called for an independent and impartial probe

They added that agencies like CBI and NIA should not be given the case and there should be a SIT probe into Judge Loya's death.

Mr. Uike had been introduced to Judge Loya by Advocate Shrikant Khandalkar and retired District Judge Prakash Thombre. All three of them were then informed about and given the copies of the draft order by Judge Loya, who had sought their help in dealing with the “pressure” that he was facing to exonerate the accused in the Sohrabuddin murder case.

In a video call with Advocates Uike, Khandalkar and Thombre, judge Loya allegedly named few powerful people who were pressurising him to deliver a favorable order.

Judge Loya claimed that he had been handed over a draft order which he was asked to deliver in the case. A copy of the draft was sent to retired district judge Thombre.

Barely three weeks before Judge Loya’s mysterious death, Thombre and Uike travelled to New Delhi to consult senior lawyers. But the lawyers felt there was insufficient evidence to approach the court. Uike and Thombre thereafter returned to Nagpur on November 9.

Advocate Khandalkar confided to Uike that he was receiving threats from Justice Gavai and Advocate Ketki Joshi

Khandalkar’s body was found in the District Court premises of Nagpur on November 29, 2015. He allegedly fell from the 8th floor. With November 28 being a holiday, his body was discovered after two days

Thombre also told Uike that he was receiving threats to his life and had been told that Justice Gavai would stop his pension

On May 16, 2016 Thombre died in Hyderabad while travelling in a train from Nagpur to Bangalore. He was said to have fallen from the upper berth and broken his spine

Advocate Satish Uike has also received threats and on June 8, 2016 iron material weighing five thousand Kilograms fell on his office roof, completely destroying the office. He had stepped out of the office barely a minute ago.

Giving details of the suspicious circumstances, Congress leaders posed the following questions:


Why was police security provided to judge Loya withdrawn in Mumbai from November 24, 2014?

Why was no security provided to him in Nagpur?

Why is there no travel record of Judge Loya who had travelled from Mumbai to Nagpur in a train?

Why is there no entry of Judge Loya or Judge Modak in the occupancy register of Ravi Bhawan, the VIP guesthouse in Nagpur in which he had stayed?

Why did Dr Tumram conduct the post-mortem examination without information to the family members of judge Loya and after obtaining consent of the immediate family members?

Mr. Uike, who was present at the conference, referred to Judge Loya’s post-mortem report to claim that it had been tampered with as the papers showed that the doctor conducted two post-mortems at the same time. Judge Loya’s ‘viscera forwarding form’ was also repeatedly referred to, to highlight such discrepancies.

Mr. Sibal, then, raised questions such as, “Why was Judge J.T. Utpal, Judge Loya’s predecessor in Sohrabuddin Fake encounter case transferred from hearing the case despite Supreme Court order specifying that the same Judge will hear the matter from start to finish?

Why didn’t Bombay High Court lodge an FIR when Judge Loya’s sister alleged that Justice Mohit Shah offered him a bribe of Rs. 100 crores? Why didn’t the judiciary take up the matter? Who was being saved and why?”
