In Depth Delhi Gang Rape – Police Filed Chargesheet against six accused


On Thursday, Police filed chargesheet in Delhi Rape Case against six, which includes one minor.
The accused have been charged for the offences of
1)  
section 302-murder

2)
section376 - gangrape


3)  
section 307 - attempt to murder

4)  
section 365  - kidnapping or abduction with intent to secretly or wrongfully confine a person

5)  
section377 - unnatural offence

6)  
section 396 - dacoity with murder

7)  
section 394 - voluntarily causing hurt in committing robbery

8)  
section 201 -  destruction of evidence

9)  
section 120 -criminal conspiracy

10)  
Section 34 - common intention

Under the Indian Penal Code.

The chargesheet was filed before metropolitan magistrate Surya Malik Grover.

The trial will be held in Camera.
The hearing in the gangrape case will take place on a day-to-day basis with no adjournments at a fast-track court

The court has posted the matter for hearing on January 5 before the area magistrate
Then it will be tried by the Sessions Court.

Chargesheet says that crime was executed in a "well-planned" manner.

On December 16 - Accused Ram Singh and other accused had a party at their place and then took the bus out at night just to earn more money to buy more alcohol
The girl and her friend got into the bus at the Munirka bus stop, after which some of the accused made lewd comments and it led to an argument between the two groups and the girl and the boy were assaulted by the accused.
While the boy was hit with a rod, the girl was gang raped.
They then pushed the student and her friend on to the road.
The bus driver tried to run Amanat over, but her friend managed to push her out of the way.
 She died two weeks later in a Singapore hospital.

Public prosecutor Rajiv Mohan told reporters that DNA report has established the involvement of all the accused in the crime.

The case of juvenile will be filed before the Juvenile Justice Board.
He says he is 17 year old but bone test will decide his real age.
If the sixth accused who is minor is tried as a minor then he will get only 3 year of imprisonment.

The court will also hold an inquiry to ascertain the age of the juvenile.

If a bone test certifies that the boy is not a minor and he is above 18 years, then a supplementary chargesheet will be filed by Police.

The police have also arrested Dinesh Yadav the owner of the bus in which the crime was committed for violating rules to get permit. The police registered a case of cheating against him
