Maharashtra Bans Strike Do Strike Go to Jail No Bail MESMA

Last December Maharashtra Government made few amendments in the Maharashtra Essential Services Maintenance Act, 2011 (MESMA).


A notification to this effect came into force on Friday, following a presidential nod to amendments in the Maharashtra Essential Services Maintenance Act, 2011 (MESMA).

If striking employees in any sector (be it public, private or unorganized) are to adversely impact public life and the concerned establishment notifies the strike as illegal, then the employees refusing to work can be booked under the amended Essential Services Act,"

What is essential service?


Following are the few services which are included or called as a essential service.

1.  
public transport such as auto rickshaws, taxis and school buses

2.  
individuals employed in hospitals

3.  
government, semi-government establishments

4.  
high court employees

5.  
civic staff

6.  
teaching staff

7.  
those engaged in the supply of milk, water, gas, and electricity

According to the Tamil Nadu Essential Services Act, those indulging in an illegal strike invite conviction and punishment with imprisonment up to three years and/or a fine of up to Rs 5,000.

Now According to Maharashtra Essential Services Maintenance Act, 2011 (MESMA)
any person engaged in an essential or public service who supports a strike will face a prison term of up to one year, or be slapped with a fine of up to
Rs 2,000 or both.

According to new amendments, police can arrest offenders without a warrant and the offence has been made non-bailable.
In other words, those booked in an illegal strike case will have to
move court to get bail.

Well,those who make the law break it.The same political parties order strikes. In Kerala, Bandhs were banned by law.But we have Hartal every day.This week itself,we had two days of hartals and one black day! No politician has ever been punished for advocating strikes,leave alone for corruption!
