DMK MP Kanimozhi to call PM Manmohan, P Chidambaram as a witness in 2G scam –
Advocate Sushil Kumar is representing the 2G scam accused A. Raja and DMK MP and 2G accused Kanimozhi.

Before the CBI Court DMK MP Kanimozhi told to Delhi Court that CBI didn't take sanction from the Rajya Sabha to file a chargeseheet against her.
This is one of the reason we need Janlokpal Bill.


DMK MP Kanimozhi told to Delhi Court that Prime Minister Manmohan Singh and Home Minister P Chidambaram, who was then finance minister, knew that the spectrum will not be auctioned and that Mr Raja had decided to sold the licenses at rates determined in 2001.

Further the advocate Sushil Kumar told to Delhi Court that He will call Prime Minister Manmohan Singh and Home Minister P Chidambaram, who was then finance minister to appear as a witness in this case if Kanimozhi is not discharged from this case.

advocate Sushil Kumar, appearing for Kanimozhi, told the Special CBI Judge O P Saini that "I am showing you (judge) the minutes of the meeting in which the Prime Minister, the then Finance Minister and the Telecom Minister decided that the licences for the 2G spectrum was not to be sold/auctioned,"

Further he said that The CAG report (of loss of Rs 1.76 lakh crore to the state) was laid before the House on November 16, 2010. It had not been adopted by the House.
The house has still not adopted the Report.

Where is the sale (of the licences)? Where is the cheating?

Advocate Sushil Kumar argued that "The sale of equities by Swan Telecom Pvt Ltd and Unitech Wireless (Tamil Nadu) Pvt Ltd (the two alleged beneficiaries of the scam) to foreign firms, Etisalat and Telenor, respectively were approved by the government. It was not the sale of the licences and hence there was no loss,"

He also trashed the computation of loss by the CBI and the Comptroller and Auditor General (CAG) saying they are "just notional loss" and cannot be a basis for prosecution of the accused.
He said that the case of the CBI is based on that the accused caused huge loss to the state exchequer by not auctioning the licences for the 2G spectrum.

He said that Prime Minister, Finance Minister and Telecom Minister all said that there was no loss.

As there is no loss then there is no cheating factor also, thus the Accused should be discharged from the case.

Another important point from this case we have to understand the necessity that the all the MPS should and their behavior in Parliament should come under the Lokpal Bill.
Including Prime Minister also.

I still do not understand why crimninals and corrupt politicians like BSY and Katta, Sampangi etc are not treatedlike Kanni and Raja. Why this difference. Law should be the same for one and all. The soft corner shown in Karnataka to criminal politicians shows how corrupt our structure is, and that is how Katta is given bail.may be BSY also gets t becuse he has enough money to buy judges /court etc. Should we not curb this. Will the juduciary do something about this.
