Government of India, Centre through a notification issued on June 9, had placed the agency in the organizations listed in the second schedule of Section 24 of the RTI Act.

The exemption granted to agencies listed in the second schedule does not give blanket immunity from making disclosures.


CBI got the exemption now but 3 months back Mr Agrawal had filed four RTI applications.
Mr.Agrawal wanted to know details of corruption cases accusing officials and ministers of amassing disproportionate assets.
The questions asked by him pertained to recoveries done by the agency from the accused and fine slapped on corrupt officials on the orders of courts.

The Central Public Information Officer of the CBI refused to provide information.

After that Agrawal filed appeal in before the Central Information Commission.

V Narayanaswamy, Minister in the Prime Minister's Office, told NDTV that "The CBI is investigating various matters which involve national security. Therefore base on the opinion given to us by the Attorney General, we have done it (exempted the CBI),"

Indias first Chief Information Commissioner Wajahat Habibullah now who is the Chairperson of the National Commission for Minorities had said that CBI does not collect intelligence or performs security related duties and does not "fit" the criteria laid down for organizations, listed under second schedule of Section 24 of the RTI, which are exempted from disclosing information under the Act.

Committee of Secretaries approved an earlier recommendation to keep the National Investigation Agency (NIA) and National Intelligence Grid (NATGRID) outside the purview of the RTI Act.

CBI is investigating agency same way National Investigation Agency (NIA) is also investigating agency.

Difference is that now CBI is handling big corruption cases in India and Right to information act is troubling all the corrupt people and politicians of India.

Corruption and National Security I do not understand the relationship if any Indian citizen wants the details of Indian nuclear submarines or power plants or someone wants the details of CBI informers then I can understand yes it’s a national security or that information should be kept secret.

National Security = Locations of Air force fighter planes , Navy and Army base locations , PM security details etc .

Every Indian has a right to know the name of thief and who is robbing India by not paying taxes.

What harm will happen to India and Indian citizens if citizens of India know about the criminals and tax thieves.

completely agreed. Its all about saving them not to disclose them in front of public who really need to know about such things.
