Police take action on goan Lavu Chodankar on FB comment against Narendra Modi

Goa businessman Atul Pai Kane, who heads the Bharatiya Janata Party (BJP) led Goa government's committee on investment and industrial policy, had lodged a complaint against Chodankar.

The cyber crime cell of Goa Police had moved the court seeking custodial interrogation of accused Lavu Chodankar claiming that his Facebook post was a larger game-plan to "promote communal and social disharmony" in the state.

The police had filed an FIR under Section 153(A), 295(A) of the IPC, besides Section 125 of the Representation of People Act as well as Section 66-A of the Information Technology Act.

First Information Report (FIR) was filed against 31-year-old Devu Chodankar on Friday after he allegedly posted anti-Narendra Modi remarks on a Facebook group in March.

He has not answered the two summons issued to him by the Goa Police cyber cell and a local court has turned down his anticipatory bail plea.

First post reported that in the run-up to the Lok Sabha election campaign, Chodankar in a post on Goa+, a popular forum with over 47,000 members, claimed that if elected to power Modi would unleash a "holocaust". He deleted his post subsequently.
However, justifying his post on another popular local Facebook forum, Goa Speaks, Chodankar while apologizing for his choice of words stood by the sum of his argument, calling it his crusade against the "tyranny of fascists".

Cyber-crime expert Dr Samir Kelekar alleged that police had filed the FIR to 'harass' Chodankar while Sardesai said, "Modi needs to be magnanimous and should not indulge in such petty things."

The District and Sessions court had yesterday rejected anticipatory bail plea of Chodankar, who is currently out of station.

How can a comment be a game plan to promote communal and social disharmoney

If one does not like the comment then he should write another comment proving that the comment was wrong

India needs to give 100% freedom of speech to  Indian citizens, let the people decide and allow the people to say whats in their heart and mind openly

In the name of freedom of speech, some commenters do cross the line of decency in FB posts. But I don't think it is a good idea to arrest people for such a small thing - maybe they could warn the involved people initially.

Secondly, the audience to which anyone can propagate a message on FB is very limited - it's a personal network, after all. Hence, this cannot be treated in par with people speaking in a large meetings or something getting published in the press/media.

We need separate (less stringent) laws applicable for social networks like FB and twitter, especially if the people involved are individuals and not a part of political/other organizations. Hope the Govt. will analyze, debate and pass the required laws soon.

I agree to DI...broadly..

Will say one thing that now when he has been elected with a massive mandate, people should avoid using bad language..now he is not a BJP candidate but Prime minister of our country, and we can not belittle him for nothing..let him work and if he does something wrong then criticise his work, but to spread rumours or running hate campaign is not ok and cant be supported.
