PIL Allahabad High Court Sachin Tendulkar Not eligible to be nominated in Rajya Sabha Upper House  do you think Sachin Tendulkar is eligible

On May 2 , Advocate Ashok Pandey filed a petition in court and sought direction for quashing the nomination of Sachin Tendulkar to the Rajya Sabha , Upper House.

Petitioner in his petition alleged that the  nomination of Tendulkar was against the legal provisions and was in clear violation of the constitution.

He said that Tendulkar's nomination as "a renowned sportsman" was in violation of the Article 80(3) of the constitution.

A division bench comprising justice Devi Prasad Singh and Justice Saeduzama Siddiqui passed the following order today.

The court directed to place a writ petition filed against famous cricketer Sachin Tendulkar's nomination to the Rajya Sabha before the division bench dealing with PIL matters on May 7.

Know about Article 80[3]

Article 80(3) in The Constitution Of India 1949

(3) The members to be nominated by the President under sub clause (a) of clause ( 1 ) shall consist of persons having special knowledge or practical experience in respect of such matters as the following,
namely:

1.    Literature

2.Science

3.art

4.social service


Cricket is  not  literature.

Cricket is not a science.

Cricket is not a social service but its money making game.

Do you think  cricket is Art?

First one needs to understand what the meaning of Art is?

In simple terms Art means  skill or craft.

In Generally speaking art means or includes or refers to

1.    painting

2.film

3.photography

4.sculpture

5.    visual media

6.Music

7.    theatre

8.dance

9.literature

10.interactive media

Britannica Online defines art as "the use of skill and imagination in the creation of aesthetic objects, environments, or experiences that can be shared with others."

Cricket is a game , which one may say it is a game which requires art, one may say that it does not require any type of art.

Cricket is a game played by 11 humans and not individual.

Art is very vogue word 
If  Amit says doing ABC is  is ART , same time Rahul will say he do not think its an art form.
doing ABC is not art form.

whats is an ART for me  may not be a ART for you.

Classic example is Pornography and adult movies.

Art keeps changing like painter he paints different each time.
Musician he creates new music all the time.

Cricket it has no change it is static.

One human throws ball, other uses bat and tries to score 4 Runs or 6 Runs this never changes.
In every cricket game its same thing.

Repetition of the same action again and again.

Art is expressing something, sending some type of message.
Art is giving beautiful things to the world.

It’s not very easy to define ART.

Playing cricket is not ART.

If you think Playing cricket is an Art then everything will become Art.

As Individual Sachin Tendulkar  deserves to become President of India or Prime Minister of India .

But I do not think Cricket is an Art , Cricket is a game played by 11 humans to make profits.

Sachin Tendulkar should contest the elections and I am sure he will win the elections in lower house.

He should stand for the election of President of India and if he wins every Indian will become a happy person including me.

But we should never give the title of ART to the game of Cricket
If we do this then everything will become ART,
Passing the Exam of CA will become ART.
Passing the UPSC exam will become ART.

Everything will  become ART if  Cricket is declared as ART form.

ART is creating something new not the repetition of actions to make profits

ART has no rules but Cricket got its own rules which one is not allowed to break.

If cricketer says he will not obey or follow the rules of  cricket game
Then that cricketer will never get a chance to play the cricket or became of cricketer.

But musician he can experiment with his music even if someone likes or not.

Example is RAP music , Remix Music.

Finally Cricket is not an ART form so Sachin is not eligible to be nominated to Upper House.


But legally Art will be defined as
To utilize knowledge or skill according to rules and principles to create something.
So one can easily declare the game of cricket as an ART form.

But one should go into the  deep and then he should decide
The game of cricket is an art form or not.

Create something what a sixer , a 100 , or record? 
is it a ART?
