for Binayak Sen release – Time Line

1.
Dr Sen was arrested from Bilaspur on May 14, 2007.


2.
The Supreme Court granted him bail on May 25, 2009.


3.
Dr Binayak Sen was convicted for sedition and sentenced to rigorous life imprisonment by a Raipur court on December 24, 2010.


4.
On January 24, 2011 Chhattisgarh High Court began hearing on suspension of his sentence.

5.
On February 10, 2011, the High Court dismissed his bail plea.

6.
Chhattisgarh High Court denied him bail.

7.
Appeal; petition was filed in the Supreme Court of India against the denial of bail by High court.

8.
The Supreme Court on March 3, 2011 admitted a special leave petition (SLP) and issued notices to the Chhattisgarh government, giving it four weeks to reply on Sen.’s bail plea.

9.
On March 11, 2011 the prosecution asked for more time.

10.
Then date was fixed for April 15, 2011 and after hearing case Supreme Court granted bail to Dr.Sen.

Supreme Court said that it was giving no reason for granting bail to Dr. Sen and left it to the satisfaction of the trial court concerned to impose the conditions for his release on bail.

SC also said that even if he is a Naxal sympathizer, it does not make him guilty of sedition.

13.
We are a democratic country. If Gandhian literature is found on some one, it doesn't make him a Gandhian.

The court also observed that possession of Naxal literature is not a proof of sedition.

Monday, April 18, 2011 – Around 7 PM Binayak Sen released from Raipur Central Jail

The trial court in Chhattisgarh had set five conditions for his release.

17.
Chhattisgarh Court of Additional District and Sessions Judge BP Verma directed that Sen be released on a personal bond and surety of Rs 50,000 each.

18.
Sen has to surrender his passport, he can't leave India without prior permission and he has to appear before the Chhattisgarh High Court for the trial whenever required.
