Congress Rahul Gandhi to face Criminal Trial in RSS Defamation Case

RSS activist Rajesh Kunte, filed the criminal defamation complaint against Mr. Rahul Gandhi for his 2014 Bhiwandi election speech.

After that Rahul Gandhi filed the appeal in the case to quash the criminal case against him

Amethi MP and Congress vice-president Rahul Gandhi on Thursday refused the Rashtriya Swayamsevak Sangh's demand for a statement that the organization has no role to play in Mahatma Gandhi’s assassination, and opted to face trial for criminal defamation for his 2014 Bhiwandi election speech.

Rahul Gandhi's counsel Kapil Sibal told the court that Rahul stands by his statement "RSS ke logon ne Gandhiji ko goli mari" and that Rahul will not withdraw his words and will "repeat what he said."

Congress vice president Rahul Gandhi last week insisted that he stood by 'every single word' said by him. 'I will never stop fighting the hateful & divisive agenda of the RSS. I stand by every single word I said,' he tweeted.


Advocate Kapil Sibal told to Supreme Court that “I have always said that. I will say it now. I will always say that. Let this case go to trial,”
I have said only what Nathuram Godse’s brother said. Nothing more,” Mr. Sibal said.

December 15, 2014 – Bombay High Court same case
Senior advocate Kapil Sibal, appearing for Rahul, cited the affidavit filed before the high court saying he had only accused certain people of the RSS and not the organisation as the killer of Mahatma Gandhi.
'I never made the statement that RSS killed Mahatma Gandhi but persons associated with the RSS killed him,' 
affidavit submitted by Mr. Gandhi in the High Court, Advocate Kapil Sibal quoted that also.
“The assassination of Mahatma was a result of destructive philosophy of the persons associated with the RSS. It was also clearly suggested that the assassins were associated or affiliated with the RSS. He never accused the RSS as an institution of the crime,”
The 2014 affidavit had explained the context of Mr. Gandhi's reference to Sardar Vallabhai Patel in the same speech. This bit had also come under scanner.

“The second part deals with the attempt of the Opposition to appropriate the legacy of Sardar Patel, an eminent leader of the Congress during the pre-Independence and post-Independence period. It is highlighted in the speech that Sardar Patel had written about the RSS candidly and clearly. In other words, one gets the impression that Sardar Patel had been critical of the RSS,” Mr. Gandhi said in his affidavit.

The affidavit had also said that “it is again proved beyond a shadow of doubt that RSS has been consistently pursuing a majoritarian agenda and attaches utmost importance to the propagation of its own self-proclaimed version of Hindu culture and its own self-proclaimed version of Hindu nationalism.”

Mr. Gandhi withdrew his petition in the Supreme Court to quash the criminal defamation complaint and summons issued against him.

Supreme Court said that We are not inclined to interfere now. Let the trial Magistrate proceed according to law,”
The Supreme Court refuses to give exemption to the Congress VP from personal appearance before the Bhiwandi court in Maharashtra in the case.

To end the case complainant RSS activist Rajesh Kunte wanted a written statement from Gandhi saying that the RSS has no role to play in the assassination of Mahatma Gandhi.
