Bombay HC Return Land Subhash Ghai Whistling Woods former CM Vilasrao Deshmukh

But in year 2000 the price of that plot was Rs. 66.21 crore.



Any intelligent and honest person can say the above contract is illegal and not good for any state.
It’s the property of citizens of India and no one has got right to sell the property of Indian citizens by suffering losses when it is giving profits.

CAG's report also raised objections about handing over the land at a low value of Rs 3 crore.


Public interest litigation was filed by Rajendra Sontakke and four other agriculturists from Latur and Osmanabad districts alleging "gross abuse of power" by former Chief Minister Vilasrao Deshmukh in allotting the land piece.

After filing of PIL even an attempt was made to regularize it.


After hearing the Petition Bombay High Court ordered following and said following.

division bench of Chief Justice Mohit Shah and Justice Girish Godbole quashed a joint venture pact between Maharashtra Film Stage and Cultural Development Corporation on October 24, 2000, and Ghai's company, Mukta Arts.

High Court Justice Girish Godbole said, "It is a classic example of arbitrary, unreasonable and illegal decision of permitting use of available land owned by the government without any authority in law."

The bench said that the agreement signed between Mr. Ghai's company Mukta Arts and the Maharashtra Film, Stage and Cultural Development Corporation (MFSCDC) is “illegal, arbitrary and without authority of law

The court cancelled the land allotment and directed Ghai to immediately return 14.5 acres.
The remaining land will be taken back in 2014, so that the students admitted in the film school are not affected.

Court said that Maharashtra government violated all norms for giving land to producer Subhash Ghai.

former CM Vilasrao Deshmukh is now Union science and technology minister.
Regarding the Vilasrao Deshmukh court said following –
Deshmukh has clearly misused his official position as CM and it is certainly not acceptable that a chief minister will personally sign an agreement as a witness, though such agreement is completely illegal and does not have any support or authority even in the form of a resolution

The court directed Ghai to pay market rent to the government for the entire period from the date the joint venture was signed in 2000 till the time the 14.5 acres is returned to the corporation.

They directed that Rs 5.30 crore rent will be payable till July 31, 2014, with an interest of 6% on the remaining 5.5 acres.

Court said that they will not order CBI to take action against Deshmukh.

The judges stayed their verdict for six weeks to enable Ghai to move the Supreme Court.

sm, What a coincidence to reach this post, I was trying to search some photography blog and your blog came at No.1 position...I had missed reading this news when you posted..to my surprise the news is related to Film city. I used to roam in jungles around Film city during school days..Film city has grown so much in last few years. This land is precious green belt of Mumbai and 3 cores is like giving it for free...Entire Aarey colony area comes under Adivasi reserve but still lot of land was sold to builders...some land is owned by Balasaheb Thakare too. Gajanan Kirtikar owns one restaurant there. I guess in few more years all reserved land will be sold to builders. They must preserve the charm of Green Aarey colony.
