Madras HC issued notice to 10 Telecom Companies regarding extra charge on SMS on festival day


Petitioner Arunachalam filed a petition in Madras High Court seeking a direction to the companies and the Telecom Regulatory Authority of India (Trai) not to hike the tariff for this period as well as he sought an interim stay on undue and sudden hike on SMS charges
During important festivals and special occasions like New Year’s Eve on December 31 and
January 1.

He said that mobile operators, regardless of tariff plans would charge Rs 1.5o per SMS on
Dec 31, "which is unfair." Last year SMS revenue of the companies was Rs 100 crore.
Further he said that extra tariff was collected was Pongal, Christmas, New year,
Valentines Day, Independence Day and Diwali.

After hearing him Bench issued notices to the Trai chairperson and Zonal/Regional
Managers of 10 companies on a petition seeking to bar them from charging extra for
SMSes during festivals and other important days.

Following are the names of 10 Mobile companies to which Bench issued notice.

1. Bharti Airtel ltd

2. Aircel Ltd

3. Vodafone

4. Reliance

5. Idea Cellular

6. Unitech

7. Tata Docomo

8. MTS mobile

9. BSNL mobile

10. Videocon

The next date of the case is January 21 2012.

Let us hope High Court will now stop the mobile companies from charging extra for SMS on the special days

But, aren't they free to fix the tariff as per market conditions/ demand? I guess its mandatory to inform people about the change in prices, and many of them do. But I am not sure whether the fixing of prices itself can come under question?
